Imagine Lawyers Limited Liability Company (“Imagine Lawyers”, “us” or “we”) respects your privacy and commits to collect, maintain and use your personal data responsibly. Imagine Lawyers is a full service independent Ukrainian law firm with a registered office at 13A Universytetska Strett, Kyiv, 03110, Ukraine. Imagine Lawyers provides full-scope legal advice and represents clients on a wide spectrum of matters arising in the course of doing business in Ukraine.

Please be informed that this Policy serves also as notification on personal data processing under Article 12 of the Law of Ukraine “On Personal Data Protection” No. 2297-VI as of 1 June 2010. By this Policy, you have been notified on (i) data controller of your personal data; (ii) nature and scope of personal data to be processed; (iii) purposes of data processing; (iv) parties to which personal data may be transferred; (v) your rights with regard to personal data processing.

 What data we collect

You may wish to receive customized newsletters, legal alerts or marketing materials, or submit us a request on any query you may have, or provide us with your CV for the purpose of recruitment, by contacting us directly via the contact form available in various sections of our website.

Unless you do so, you are not required to provide any personal data to use this website.

In case you approach us, you may voluntarily provide us with the following data which we will process:

  • Name and last name;
  • Email address and telephone number;
  • Name of the company that you represent;
  • Information that you provide as a job candidate (name and contact information, professional credentials and skills, educational and work history, salary, evaluations, references, certifications, other information of the type included on a resume or cover letter);
  • Any other information that you choose to provide to us.

This website uses “cookies”. Cookies are small text files that are stored in the memory of your terminal via your browser. We use personal data to understand whether you read the emails and other materials that we send to you, click on the links to the information that we include in them, and whether and how you visit our website after you click on that link (immediately and on future visits). We do this by using software that places cookies on your device, which tracks this activity and records it against your email address. We may also use your personal data to invite you to seminars or other events, to respond to your requests, enquiries or complaints, to conduct administrative or operational processes within our business or to send you marketing information.

We may ask whether you wish to receive marketing information from us. We will not send you marketing information if you ask us not to. If you do not wish to receive marketing information from us, please let us know at info@imaginelawyers.com so that we can remove you from our distribution lists.

When you visit our website our server will record your IP address together with the date, time and duration of your visit. An IP address is an assigned number, similar to a telephone number, which allows your computer to communicate over the Internet. It enables us to identify the organisations which visited our website. We use this information to compile statistical data on the use of our website to track how users navigate through our site in order to enable us to evaluate and improve our site.

How we use your personal data 

We may use your personal data for the following purposes:

  • to handle requests made through the website and provide the services requested by you;
  • for the purposes of recruitment;
  • for marketing and promotional purposes;
  • to invite and register for events;
  • to administer and improve our website;
  • for any such other purposes as may be required or permitted by law.

Sharing your data

In relation to any other third parties we will only disclose your data where you have given your consent or where we are required to do so by law, or where it is necessary for the purpose of, or in connection with, legal proceedings or in order to exercise or defend legal rights. How we protect your personal data

Our website uses measures that are appropriate to protect your personal data against unauthorized access, improper use or disclosure, unauthorized or unlawful destruction or accidental loss, and all our employees and any third parties that process your personal data on our behalf are obliged to respect the confidentiality of your data. However, we cannot and do not provide any assurance that these measures will be sufficient to protect the data you choose to transmit to our website. 

Cookies

There are three categories of cookies:

  • functional cookies, without which the functionality of our website would be reduced,
  • optional cookies, which are used for website analysis and marketing purposes, and
  • analytical third party cookies.

When you call up our website, your browser will transfer certain data to our web server. This is done for technical reasons and required to make the requested information available to you.

Our server logs capture information regarding your IP address, the date and time of the access, the time zone difference to Greenwich Mean Time (GMT), the content of the request (a specific website), the status of the access/HTTP status code, the transferred volume of data, the Website requesting access, browser, and language settings, the version of the browser software, and the operating system and surface.

To protect our legitimate interests, we will store such data for a limited period in order to be able to initiate a tracking of personal data in the event of actual or attempted unauthorized access to our servers.

Functional cookies do not require your consent. You may refuse the use of cookies at any time by selecting the appropriate settings on your browser but please note that this may affect your experience of using our website. By continuing to use our website without changing your privacy settings, you are agreeing to our use of cookies.

  • Optional Cookies  

We only use optional cookies if we have obtained your prior consent. Upon your first access to our website, a banner will appear, asking you to give us your consent to the setting of optional cookies.

If your consent is given, we will place a cookie on your computer and the banner will not appear again as long as the cookie is active. After expiration of the cookie’s lifespan, or if you actively delete the cookie, the banner will reappear upon your next visit to our website and again ask for your consent.

  • Analytical Third Party Cookies

Our website uses Google Analytics, a web-based analytics tool that tracks and reports on the manner in which the website is used to help us to improve it. Google Analytics will analyze your use of our website on our behalf.

Google Analytics does this by placing ‘cookies’ on your device. The information that the cookies collect, such as the number of visitors to the website, the pages visited and the length of time spent on the website, is aggregated and is therefore anonymous.

You may withdraw your consent to the use of web analysis at any time, either by downloading or installing a Browser Plugin offered by Google. This option will prevent the use of web analysis only as long as you use the browser on which you installed the plugin or if you do not delete the opt-out cookie.

Your rights

According to the Law of Ukraine “On Personal Data Protection’ No. 2297-VI dated 1 June 2010, you as the personal data subject are entitled to:

  • be aware of the sources of collection, location of your personal data, the purpose of data processing, the address of the controller or processor of the personal data or to obtain the said information through your representatives;
  • obtain information regarding the conditions of providing access to personal data, and in particular, information on third parties, to which your personal data is transferred;
  • access your personal data;
  • obtain a reply within 30 calendar days from the date of the receipt of your request, informing whether your personal data is being processed and to receive the contents of such personal data;
  • provide the controller of personal data with the reasonable request to terminate the processing of your personal data;
  • provide a reasonable request to change or destroy your personal data by any controller and processor of the personal data if the data is processed illegally or is inaccurate;
  • protection of your personal data from unauthorized processing and accidental loss, elimination or damage with respect to intended concealment, not providing or the untimely provision of personal data, and to protection from providing invalid or discrediting information regarding the individual;
  • appeal violations in the course of personal data processing to the Ukrainian Parliament Commissioner for Human Rights (the Ombudsman) or to the court;
  • introduce limitations as regards rights on your personal data processing while giving the consent;
  • use the means of legal protection in the case of violation of legislation on personal data, revoke your consent on personal data processing;
  • be aware of the mechanism of automatic personal data processing; and
  • be protected from the automated decision that has legal effects.
